Building Restrictions

Home Size, Garages, Storage & Driveway Requirements

Minimum Home Size Requirements:

a)   Only one single-family home may be constructed on each lot with the exception of Lot #19. All lots, except for Lot #19, shall have the following minimum sizes exclusive of porches, garages, patios and similar additions:

b)   For purposes hereof, “more than one story” includes homes referred to as one and a half story, two story, split-level or tri-level. The type of residence and the number of square feet shall be determined on a uniform basis by the Architectural Control Committee (ACC) and shall not include basement, attic, garage or patio areas in the computation.

Garages, Storage Sheds and Driveways:

a) Each residence on all Lots, except for Lot #19, shall have a garage for not less than three (3) cars attached to the residence containing a minimum of 600 square feet. All garages shall be oriented to not directly face upon a public street except for corner lots. No garages may directly face a public street without prior approval by the ACC.

b) Storage sheds and outbuildings are prohibited and will not be allowed within this development.

c) Driveways shall be paved within twelve (12) months of Owner’s receipt of an occupancy permit for Owner’s Lot with a hard surface material acceptable to the ACC and, within its jurisdictional limits, the City of Oak Creek. All Lots shall be allowed one driveway approach to a public street. Any exceptions to this rule to allow for circle drives may be allowed upon request to ACC review, but only on Lots with total public street frontage greater than One Hundred and Forty (140) feet.

d) Commercial vehicles, boats and recreational vehicles shall not be parked outside of a garage for a period of time exceeding 24 hours. If parked or stored on any Lot within this development, the subject vehicle must be within the confines of the garage.

Certain Exterior Features:

     With respect to the construction of a Building on a Lot or other improvement to a Lot, except for Lot #19.

a) A residence shall have a roof made of wood shakes, tile, natural slate, dimensional shingles (with warranty greater than or equal to 25 years), or artificial slate as approved by the ACC, with a minimum pitch of 10:12 for the main roof. Lesser pitches will be allowed at the discretion of the ACC for architectural features such as dormers, etc. All exterior surfaces of the buildings shall be of natural materials (under this requirement, fiber cement siding is considered a natural material along with brick and other similar manufactured products). Vinyl and aluminum siding shall be prohibited and will not be allowed by the ACC.

b) Fencing proposed as a decorative feature of the Lot landscaping shall be allowed and will not require ACC approval. Any fencing proposed with the intention of enclosing a portion of a Lot shall require ACC approval and all approved fencing must meet building setback requirements per the City of Oak Creek Zoning.

c) No above-ground swimming pools shall be installed. In-ground swimming pools may be installed on a Lot with approval of the ACC, which shall be acting responsibly if it does not approve an in-ground pool which is not completely enclosed by a secure wall or fence of a minimum of four (4) feet elevation, with a self-closing or self-latching gate or door. There must be an unobstructed area of at least four (4) feet between the fence or wall and the pool. The fence or wall must meet the building setbacks as stated in paragraph (b) above.

d) The ACC shall be acting responsibly if it disapproves the Drawings for a residence because such residence would be similar in appearance to other residences in close proximity.

e) The ACC shall be acting responsibly if it disapproves the Drawings for a residence because the proposed colors of such residence would be similar in appearance to other residences in close proximity or would not be harmonious with the development as a whole.
